1. Services

Shaka Law provides comprehensive estate planning and related services, which include the creation of trusts, pour-over wills, advanced healthcare directives, powers of attorney, and other related legal documents. Our estate planning services are available through our fully remote platform so you can get everything done from the comfort of home. Shaka Law does not assist with litigation matters. Shaka Law may perform services reasonably required to fulfill your requests unless we choose, in our sole discretion, to decline any newly assigned matter. Unless specifically requested, we assume no services are required. 

2. User Responsibilities 

You are responsible for providing accurate and current information necessary for the preparation of your estate planning documents and the completion of any related services. You agree to comply with all applicable laws and regulations and to ensure that any information you provide does not violate any third-party rights. Timely communication is paramount in the ability of Shaka Law to work with you. If unable to reach you for thirty (30) consecutive days, and after making at least three unsuccessful attempts to contact you, you shall be deemed to have unilaterally terminated your relationship with Shaka Law and Shaka Law shall be discharged of any duties, responsibilities, or obligations to you, your spouse, or any of your affiliates.  

3. Privacy and Data Protection 

We are committed to protecting your privacy. Shaka Law collects, uses, and discloses personal information in accordance with our Privacy Policy, which is designed to respect and protect your data in compliance with relevant data protection laws. 

4. Intellectual Property 

All content provided on our website, including text, graphics, logos, images, and software, is the property of Shaka Law or its content suppliers and protected by international copyright laws. The use of our content without permission is strictly prohibited. 

5. A2P Compliance 

In compliance with Application-to-Person (A2P) messaging requirements, Shaka Law ensures that all communications, including SMS and emails sent from our platform, are properly registered and adhere to applicable regulations regarding sender identification and message content. 

6. Disclaimers 

No information provided on Shaka Law’s website shall be construed as legal advice.  AN ATTORNEY-CLIENT RELATIONSHIP SHALL NOT BE CREATED BETWEEN YOU AND SHAKA LAW UNTIL BOTH YOU AND A REPRESENTATIVE OF SHAKA LAW SIGN A SEPARATE ENGAGEMENT LETTER AND YOU PAY ANY AGREED UPON FEE RETAINER

7. Limitation of Liability 

Shaka Law will not be liable for any direct, indirect, incidental, special, or consequential damages that result from the use of, or the inability to use our website or services. 

8. Modifications to Terms 

We reserve the right to modify these Terms and Conditions at any time. Your continued use of our services following the posting of changes will mean that you accept and agree to the changes. 

9. Arbitration 

Any dispute arising out of, in connection with, or in relation to the interpretation, performance, or breach of this Agreement shall be resolved by final and binding arbitration conducted in Los Angeles, California, administered by the American Arbitration Association under its then existing Commercial Arbitration Rules, and any judgment upon any award rendered by the arbitrator may be entered by any state or federal court having jurisdiction to do so. By so agreeing, you and we are waiving the right to a jury trial. You understand that arbitration provides only limited discovery and that courts will enforce an award in arbitration without reviewing it for errors of fact or law. You acknowledge and agree that we have advised you to consult with independent counsel concerning arbitration and waiving your right to a jury trial, and that you have had a reasonable opportunity to do so. 

10. Governing Law 

These Terms and Conditions are governed by the laws of the State of California, without regard to its conflict of law provisions.
